According to Article 13 paragraph 1 and 2 General Data Protection Regulation of 27 April 2016, (the ‘Regulation’), we would like to inform you that:

1. The Controller of your personal data is the Institute of Mining Technology KOMAG Research Institute located in Gliwice (44-101) 37 Pszczyńska Street.

3. Your personal date shall be processed in order to following purposes:

a)      preparing offers, conclusion, and performing contracts for service and duties fulfilled by the Institute - in particular researches and certification of products, on the basis of Article 6 paragraph 1 point (b)  of the Regulation;

b)      participation in EU-funded project co-realised by the Controller, on the basis of Article 6 paragraph 1 point (a) of the Regulation;

c)      publication of your science articles in [•] on the basis of your consent, i.e. Article 6 paragraph 1 point (a) of the Regulation;

d)      matters relating to proceedings  conducted by the Controller for the award of public procurement on the basis of Article 6 paragraph 1 point (c) of the Regulation;

e)      conducting the guestbook and monitoring of  the Institute area  in order to provide safety of persons and assets over there, on the basis of Article 6 paragraph 1 point (d) of the Regulation;

f)       conducting correspondence register in order to recording outgoing and incoming mails, on the basis of Article 6 paragraph 1 point (d) of the Regulation

g)      other purposes mentioned in your freely given consent – exclusively on the basis of your consent, i.e. Article 6 paragraph 1 point (a) of the Regulation;

4. Your personal data will be processed:

a)      during a contract and after as long as it will be necessary for the security of the claims demanded and for the period that results from general valid law.

b)      for the period of participation in the project and after for the period that results from general valid law.

c)      for the period of publications of the submitted articles and after as long as it will be necessary for the security of the claims demanded and for the period that results from general valid law.

d)      in order to Article 97 paragraph 1 Polish Public Procurement Law, for a period of 4 years from the date of completion of the procurement procedure, and if the duration of the contract exceeds 4 years, the retention period covers the entire duration of the contract. After the date of completion of the procurement procedure, your personal data will be processed as long as it will be necessary for the security of contract claims and for the period that results from general valid law.

g)      until a withdrawal of the consent given;

5. Your personal data shall not be transferred to recipients  as defined in point (9) of Article 6 of GDPR  Regulation, except when it is obliged by general valid law.

6. Your personal data shall not be transferred to any third country, nor any international organization.

7. You are authorized to access all your data, correct them, erase or restrict processing as well transfer them within the limits of general valid law.

8. You shall have the right to withdraw a consent for processing the personal data at any time with no impact on compatibility with the right of processing which has been exercised on the basis on the agreement before withdrawal.

9. You shall have the right to lodge a complaint with a supervisory authority -  President of The Office for Personal Data Protection, if you consider that the processing of personal data relating to you infringes the Regulation.

10. Personal Data freely given is a condition of conclusion of the contract, participating in the project, publication of submitted articles and being a part of proceedings  for the award of government procurement.  The inability to taking actions mentioned above will be a consequence of not providing personal data.

11. Decisions based on provided data will not be taken automatically. Your personal data will not be used in profiling.
